11 марта 2024

President of Belarus Alexander Lukashenko has signed the Code of Civil Procedure, the press service of the Belarusian leader reported.

The document is designed to establish uniform rules for consideration of civil and economic cases in courts.

To this end, it defines general provisions for the consideration of the relevant categories of cases: the principles of judicial activity, jurisdiction, rights and obligations of participants in the process, etc.

In addition, the Code enshrines a number of innovations aimed at improving the efficiency of civil proceedings. These include the use of electronic evidence, the further digitalization of the judicial process, the introduction of the institution of class actions and simplified proceedings.

In order to ensure proper protection of the rights and legitimate interests of citizens and business entities, it is envisaged that all courts will review court decisions in three instances (appeal, cassation and supervision).

At the same time, the use of extrajudicial methods of dispute settlement is being expanded - through mediation, negotiation and conciliation. These measures are designed to facilitate the parties' independent resolution of the case on mutually beneficial terms.

The Code comes into force on January 1, 2026.
