Practice of criminal punishment for drug offenses considered at Presidium of the Supreme Court

The fight against illicit trafficking in psychotropics and precursors is one of the priorities of national security. As it was stated by the Chairman of the Supreme Court, Valentin Sukalo, there are no unresolved issues or an urgent need to change national legislation. It is important to pay attention to the harmonized use of a differentiated approach to the consideration of such cases in the framework of existing sanctions. The tightened measures adopted in 2014, allowed to reduce the number of convicts. For example, the number of minors involved in an illegal business has decreased three times.

Ruslan Aniskevich, Deputy Chairman of the Supreme Court of Belarus: “Recommendations to the courts: to pay maximum attention to the presumption of innocence and compliance with the law in terms of checking and evaluating evidence, since the strict responsibility. At the same time, the punishment should be as differentiated as possible depending on all the circumstances established in the case, the identity, type, size of the substance that was transported, depending on its danger. All circumstances should be fully taken into account, that is, not a mechanical approach. ”

Given the relevance of the topic, the discussion at the Presidium of the Supreme Court is being held in an expanded format with representatives of relevant departments, the Ministry of Internal Affairs, the Prosecutor General’s Office and the Ministry of Health. The meeting is held in the form of video conferencing with all regional courts.
